Join us for an informative presentation on Fair Labor Standards Act (FLSA) essentials. The presentation will provide an overview of the FLSA to give you the knowledge you need to accurately administer payroll and FLMA policies. In addition, our speaker will provide guidance regarding Break Time for Nursing Mothers. Attendees will understand hours worked, break times, and basic employer requirements and provisions of the FLSA.

Learning Objectives:

  • Identify the four main provisions of the Fair Labor Standards Act (the Act)
  • Distinguish exempt and non-exempt workers
  • Determine actual hours worked
  • Identify some common practices that cause employers to be in violation of the Act
  • Identify other laws enforced by the Wage and Hour Division
  • Understand employer requirements under the Family Medical Leave Act
  • Understand the investigative process


About Our Speaker
Malcohm Smith currently serves as the Community Outreach Resource and Planning Specialist with the Wage and Hour Division of the US Department of Labor. Put bluntly, he is primarily responsible for coordinating all outreach activities within the department and is instrumental in choosing which industries will be targeted for initiatives. Prior to this position he was an investigator with the division where he conducted investigations of pay practices and compliance guidance that fall under the Fair Labor Standards Act, Davis-Bacon Act, McNamara-O’Hara Service Contract Act, Migrant/Seasonal-Workers Protection Act, H2A and OSHA laws regarding field sanitation and living conditions for migrant workers on farms.

Prior to joining the U. S. Department of Labor’s Wage and Hour Division, Malcohm served 26-years in the United States Coast Guard.
