Roe v. Wade is Overturned - Now What?

The overturning of Roe raises a whole host of questions for employers:

  • How does the Supreme Court’s decision affect my benefits programs, including health care coverage and medical travel reimbursement benefit options?
  • How do state abortion laws affect employers that provide related benefits?
  • Can an abortion be a procedure requiring leave as an accommodation under the ADA?
  • What other accommodations issues can we foresee arising?
  • If my sick leave policies allow access to an abortion in a state where abortion is illegal, is this abetting?
  • Will states be revising their paid leave laws to require covered abortion?
  • How might abortion be characterized under the FMLA?

About Our Speakers
Karen Brandon advises in-house counsel, management, human resources professionals and Boards of Trustees on their responsibilities in sponsoring, administering and acting as trustee of all types of employee benefit and executive compensation plans. Karen has practiced exclusively in the area of employee benefits law for over 15 years. She has particular experience in the manufacturing, transportation, software, national retail and banking industries, and works with unionized, governmental and non-profit employers as well. Karen has also provided advice on employee benefit matters in the context of mergers and acquisitions, and in bankruptcy. In addition, her practice has included representation of employers during the audit of their benefit plans before the IRS, DOL and PBGC.

Sean Oliveira is an associate in the St. Louis office of Ogletree Deakins. He represents employers both before administrative agencies as well as courts at the state and federal levels. He joined the firm with nearly fifteen years of experience as a federal investigator with the Equal Employment Opportunity Commission. That experience gave him expertise in practicing before state and federal agencies such as the Missouri Commission on Human Rights and the Equal Employment Opportunity Commission. Sean began practicing just as COVID-19 began. As a result, Sean also became an expert on all things COVID-related, advising clients extensively on COVID-related topics.

A California, Bay Area native, Sean received his Bachelor’s and Master’s degrees in Philosophy from the University of California at Santa Cruz. He graduated with an employment law concentration from St. Louis University School of Law and acted as Articles Editor with the ABA Labor and Employment Law Journal. Sean previously lived in Paris for a year teaching English.
